In a significant interim order passed on 25 March 2026, the Additional Sessions Judge-05 (Link), Central District, Tis Hazari Courts, Delhi, has directed the accused, Naveen Kumar Mishra, to cooperate with the ongoing investigation in FIR No. 161/2025 registered at Cyber Police Station North. The order was issued in Bail Application No. 548/2026 titled State vs. Naveen Kumar Mishra.
The court heard partial arguments from Sh. Parvesh Ranga, Ld. Additional Public Prosecutor for the State, and the counsel for the applicant, Sh. Nitin Kumar and Sh. Gaurav Nautiyal. Investigating Officer SI Arvind was also present. After recording the submissions, the matter has been adjourned for further arguments on 4 April 2026.
While the bail plea is still under consideration, the court has issued clear directions to balance the interests of investigation and the liberty of the accused. Naveen Kumar Mishra has been directed to join the investigation as and when called by the IO after due notice. The court accepted the submission of the applicant’s counsel that notice may be served through WhatsApp on the accused’s number (8090547501) and the advocate’s number (7838489989). Such notice shall be deemed to have been duly served for all purposes.
Crucially, the court has restrained the police from taking any coercive steps against the accused till the next date of hearing. A copy of the order has been directed to be sent to the concerned SHO/IO for information and compliance, and dasti copies were given to all parties.
This order reflects the court’s approach in bail matters involving cyber crime cases — ensuring that the accused remains available for investigation while protecting him from arbitrary action during the pendency of the application. The final decision on bail will be taken after hearing the remaining arguments on the next date.
