Allahabad High Court Adjourns Expedited Child Custody Appeal in Sudesh Garg vs. Kushagra Garg to 2nd April 2026

In a fresh development in the high-profile child custody dispute, the High Court of Judicature at Allahabad on 10th March 2026 adjourned First Appeal No. 1209 of 2024 for further hearing on 2nd April 2026 at 2:00 P.M.

The Division Bench comprising Hon’ble Mr. Justice Arindam Sinha and Hon’ble Mr. Justice Satya Veer Singh was hearing the appeal filed by Sudesh Garg against the Family Court’s common judgment dated 3rd December 2024, which had, among other directions, handed over custody of the younger sibling to the respondent, Kushagra Garg.

The matter was specially assigned and listed under the heading “Hon’ble Supreme Court Order (Expedited)”. Appearing for the appellant, Advocate Vishesh Rajvanshi handed over the English translation of the impugned Family Court judgment to the court and to the respondent’s counsel, confirming compliance with the High Court’s earlier direction dated 8th January 2026. He also informed the court that all materials placed before the Family Court are already on record in the appeal papers.

Mr. Rajvanshi further requested an adjournment to the first week of April 2026 so that his client could make necessary arrangements to bring the child to court on the next date. The court accepted the request and directed the matter to be listed again on 2nd April 2026 under the same expedited heading.

The appeal is being contested between Sudesh Garg (Appellant) and Kushagra Garg (Respondent). This development comes as part of the ongoing litigation that has already drawn the attention of the Supreme Court, which had earlier directed expeditious disposal of the matter.
