Allahabad High Court Grants Interim Protection to Vikram Sandhu: No Arrest Till Cognizance in Gautam Buddha Nagar FIR Case

In a detailed order passed on 9 March 2026, the High Court of Judicature at Allahabad disposed of Criminal Misc. Writ Petition No. 2167 of 2026, titled Vikram Sandhu And Another vs. State of U.P. and 4 Others. The Division Bench comprising Hon’ble Mr. Justice Siddharth and Hon’ble Mr. Justice Jai Krishna Upadhyay directed that the petitioner shall not be arrested in connection with Case Crime No. 128 of 2024 until the court takes cognizance on the police report filed under Section 173(2) Cr.P.C./193(3) B.N.S.S.

The petition sought quashing of the FIR dated 24 February 2024 registered at Police Station Bisarakh, District Gautam Buddha Nagar, under Sections 188, 447, 353, 420, 467, 468, 471, 120-B and 34 of the Indian Penal Code. Appearing for the petitioners, Advocate Vishesh Rajvanshi submitted that Vikram Sandhu was neither named in the original FIR nor charge-sheeted in the first instance. He was implicated only during further investigation on what the counsel described as false allegations.

The State, represented by the learned Additional Government Advocate, opposed the petition. After hearing both sides and perusing the record, the Court observed that the facts and circumstances of the case warranted interim protection similar to the order dated 10 July 2024 passed in Criminal Misc. Writ Petition No. 7463 of 2024 (Shobhit Nehra vs. State of U.P.). Accordingly, the Bench restrained the respondents from arresting the petitioner pursuant to the impugned FIR, subject to full cooperation in the ongoing investigation.

The order strikes a balance between the petitioner’s right to liberty and the need for a fair investigation. It ensures that no coercive action is taken until the police complete their probe and the Magistrate applies judicial mind to the final report. The judgment once again underscores the High Court’s consistent approach in granting anticipatory protection in cases where the accused was not an original named suspect and where further investigation is alleged to have introduced new names without sufficient material.

This relief will remain in force till cognizance is taken. The matter now proceeds in accordance with law before the competent court at Gautam Buddha Nagar.
