In a compassionate ruling highlighting the nuances of remission guidelines, the Supreme Court of India has directed the immediate release of Anilkumar alias Lapetu Ramshakal Sharma, a life convict who has served nearly 22 years for murder and attempt to murder. The judgment, delivered on October 07, 2025, by a bench comprising Chief Justice B.R. Gavai and Justice K. Vinod Chandran, reclassified the crime under a category allowing earlier remission, emphasizing that additional months in jail would serve no purpose.
Sharma, convicted in 2004 by the Additional District Court in Greater Mumbai, was sentenced to life imprisonment under Section 302 of the Indian Penal Code (IPC) for murder and seven years rigorous imprisonment under Section 307 for attempt to murder, to be served concurrently. The crime stemmed from a premeditated attack by Sharma and a co-accused on the deceased and his friend, motivated by the deceasedās love affair with Sharmaās sister, which was perceived as tarnishing family prestige.
After serving over 20 years, Sharma sought premature release from the Maharashtra government. Based on a report from the convicting court, the government applied Category 4(d) of the 2010 remission guidelinesācovering joint premeditated murdersāordering his release after 24 years. Sharma challenged this, arguing for Category 3(b), which applies to premeditated murders arising from family prestige and allows release after 22 years.
The Supreme Court agreed, noting the appellate court and government had acknowledged the family prestige motive. The bench observed that Sharma, just past 18 at the time of the crime, had served 20 years, 7 months, and 8 days as of September 30, 2024ānow nearing 22 years short of three months. Stating that the extra time would offer āneither added solace to the family of the victim nor extra remorse to the accused,ā the Court ordered his forthwith release under Government Resolution No. RLP No.1006/CR621/PRS-3 dated March 15, 2010.
