Delhi High Court Grants Bail to Vijay Ujjwal in 2023 Arms Procurement Case Linked to Murder

Ujjwal, in custody since July 11, 2023, was accused of facilitating the procurement of the firearm from Uttar Pradesh, receiving ₹44,000 via PayTM on May 10, 2023, and additional cash (₹12,500 + ₹8,000) for ammunition. Evidence included disclosure statements from co-accused Ankit and Sagar Ujjwal, CDR/location data. Charged solely under Section 25(8) of the Arms Act (unlike Ankit’s Sections 302/506 IPC and 25/27 Arms Act), no weapon was recovered from him.

The court noted Ujjwal’s limited role, circumstantial evidence, two-month gap between transaction and crime, lack of direct proof, and prolonged detention violating Article 21. Bail was granted on a ₹50,000 personal bond with one surety, conditions: court appearances, no evidence tampering, no leaving India without permission.
