SC Issues Notice in Bail Pleas of Azam Khan and Son in Stolen Machinery Case

The Supreme Court on December 16 issued notices in Special Leave Petitions filed by Samajwadi Party leader Mohammad Azam Khan and his son Mohammad Abdullah Azam Khan, challenging the Allahabad High Court’s refusal to grant them bail in a stolen machinery case. The petitions were heard by a bench of Justices M.M. Sundresh and Aravind Kumar, which sought a reply from the Uttar Pradesh government. Senior Advocate Kapil Sibal appeared for the petitioners.

The case pertains to allegations that during the previous Samajwadi Party government, machines purchased with public funds were illicitly used at Jauhar University, where Azam Khan serves as Chancellor. FIRs under Sections 409, 411, 201, 120B IPC and Sections 2/3 of the Damages to Public Property Act were registered against Azam Khan, Abdullah Azam, and others for allegedly concealing, dismantling, and burying the machines to evade detection after a change in government.

The High Court rejected their bail applications on January 29, observing that both accused have extensive criminal histories and prior convictions. It expressed concerns that their release could hinder the trial, as key witnesses are University employees who might be influenced.

The Supreme Court, while issuing notice, has not passed any interim relief. The matter will now proceed as the State is directed to respond.
