The disciplinary committee of the Bar Council of India had suspended Katiyar on March 11, 2022, for misconduct. Despite the suspension, Katiyar contested the elections while continuing to act as if he were a full member of the Bar. The bench, led by Chief Justice of India (CJI) Sanjiv Khanna and Justice Sanjay Kumar, took a stern view of his actions. CJI Khanna remarked on the advocate’s behavior, noting that Katiyar had worn his Bar Association band, posted thank-you messages online, and solicited donations during his campaign.
Katiyar’s counsel argued for a reduction in the suspension period, citing the 2.9 years already served and the negative impact on his livelihood. However, the Court dismissed the appeal, emphasizing the gravity of his actions while under suspension.
The bench recorded its decision, stating, “Having regard to the conduct of the appellant, we do not find any good ground to interfere in the quantum of the sentence, and hence the appeal is dismissed.”
