Supreme Court Issues Notice on PIL Seeking Legal Education and Self-Defense Training in School Curriculum

The Supreme Court, on Monday, issued notice in response to a Public Interest Litigation (PIL) seeking the integration of legal education and self-defense training into school curricula. A bench comprising Justices BR Gavai and KV Viswanathan passed the order, with the matter tentatively scheduled for January 1, 2025. The PIL, filed by Advocate Geeta Rani, names all states, Union Territories, and the Union Government as respondents, highlighting the urgency of addressing increasing crimes against children as reported in the 2022 National Crime Records Bureau (NCRB) data.

The petition highlights a significant rise of 8.7% in crimes against children compared to 2021, with kidnapping and abduction making up the majority, while only 39.7% of cases were registered under the POCSO Act. It criticizes the ineffective implementation of legal education initiatives like CBSE’s optional subject introduced in 2013 and refers to the 2019 private bill titled “A Compulsory Teaching of Legal Education in Education Institution Bill”.

The plea underscores the need for such education, arguing that it will empower students with knowledge of their rights, prevent delinquent behavior, and equip them with skills to seek help or defend themselves. It calls for self-defense training, particularly for female students, in response to incidents highlighting their vulnerability due to the absence of such skills.

Relying on Article 27(1) of the United Nations Convention on the Rights of the Child (UNCRC), ratified by India, the petition stresses the government’s duty to ensure children’s physical and mental well-being through personal safety measures. It also highlights the legal protections under the Bharatiya Nyaya Sanhita, particularly Section 34, which shields individuals from prosecution for acts of private defense.

The PIL connects its objectives to the broader framework of government campaigns like “Beti Bachao, Beti Padhao,” asserting that such measures are critical for their success. Filed through Advocate-on-Record Pravir Choudhary, the petition raises vital questions about child safety and empowerment, calling for systemic changes in education to address these concerns effectively.
