NO DECISION-MAKING POWER FOR CBI!!!

In this present case, CBI filed an affidavit the plea seeking for amendment in Sec 4BA which defines director of the prosecution of Delhi Special Police Establishment Act.

They also seek for separate director of prosecution and also put the central government as an independent agency.

In the provision, The director of the prosecution should be appointed by the central government in recommendations of the Central Vigilance Commission.

But CBI has not powered to intervene in the professional functioning of its officers.

So CBI told the Delhi High court that they had no decision-making power for the appointment of the director of the prosecution.

The bench gave an extra one last chance to CBI for filing its reply in the case.
