On Wednesday, the Delhi High Court sought responses from the Unique Identification Authority Of India (UIDAI) on a plea against Google Pay for alleged unauthorized operations that violated the privacy of it’s users.
The court issued notice to UIDAI, Reserve Bank of India (RBI) and Google India Digital Services Private Ltd issued on a public interest litigation petition filed by Abhijit Mishra, a financial economist.
According to the petition, Google Pay in its terms and conditions explicitly mentions that it would collect, store and share the bank account and Aadhaar details of users however it has no permission from UIDAI or any such other authority for the same.
Therefore the said action of Google Pay lead a violation of Article 21 of the Constitution of India, Aadhaar Act 2016, Payments and Settlement Systems Act 2007 and Banking Regulations Act 1949.
Moreover, order was given toUIDAI to initiate action against Google Pay under Sections 23A, 28, 29, 38 and 43 of the Aadhaar Act 2016 for unauthorised collection, storage and usage of Aadhaar information of the citizens.
