NHRC’s neutrality in data collection of Post-Poll Violence cases in West Bengal questioned

Senior Advocate Kapil Sibal while representing the State of West Bengal challenged the Calcutta High Court order of direction for CBI investigation into the post-poll violence cases. The neutrality of NHRC’s approach towards fact finding was questioned in the matter.

The Calcutta High Court had referred to the NHRC committee’s report on post-poll violence cases. It was alleged by Sibal that the committee members were affiliated to BJP. He further questioned as to how NHRC could appoint such members who formerly held positions in BJP.

It was further argued that the High Court did not specify any procedure that is to be followed while data collection of post-poll violence cases.

The Bench asked the Senior Advocate to submit the chart he prepared to point out the various contradictions in the judgments delivered and adjourned the hearing. The bench further asked the advocate on behalf of one of the petitioners appearing before the High Court to submit a written note.
