In a response filed in response to a petition to the constitutional legitimacy of the new Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the central government upheld its constitutionality.
Numerous online media sites, including The Quint, The Wire, and others, have filed applications in the Delhi High Court contesting the recently implemented Information Technology Rules, 2021.
The petitions sought to have a portion of the IT Rules struck down because it violated Articles 19(1)(a), 19(1)(g), and 14 of the Constitution.
According to the centre’s statement, the laws aim to avoid abuse of press freedom by strengthening the public, and the complaint management process is in accordance with the spirit of the public’s right to know. It also supported the establishment of a government-run oversight system.
These regulations are designed to protect the rights of people who are covered by the media, as well as the rights of the viewer who reads, views, or shares the content, while also being responsive to the larger society, with a particular focus on the worries of vulnerable people, according to the affidavit.
