DELHI GYMKHANA CLUB’S CASE

Facts of the case:-
The case was about the company petition alleging that the affairs of the club are in a prejudicial manner to the public interest.

The petition seeking for an appointment of an administrator and to suspend the general committee.

But the order by NCLT directed the central government to constitute a special committee for functioning the Delhi Gymkhana Club.

But the arguments by the appellant in the top court said that the order passed by NCLT is impugned judgment.

It is also argued that the appointment of an administrator is contrary to the principle of law under the Companies Act.

So the Supreme Court adjourned this plea which challenging the NCLT order for suspension of the general committee and appoints the administrator to manage the Delhi gymkhana club.
