Anticipatory bail granted to the husband who pronounced triple talaq on text by the Bombay HC

The Bombay High Court on Monday held that there is nothing that cannot be solved through mediation and granted anticipatory bail to a man who was accused of pronouncing triple talaq to his wife through a message.

In the present case, the court was hearing the plea of Adnan Iqbal Moulvi who was accused under Section 498A of the Indian Penal Code and Section 4 of the Muslim Women (Protection of Rights) Act, 2019 by his wife.

In the report the wife claimed that her husband used to harass her both mentally and physically and further alleged that she was beaten up by her in-laws and was abused on various instances. She further claimed that her husband pronounced triple talaq on text and said that she could only come back if she brough Rs. 10 lakhs from her home.

The Court headed by Justice Sandeep K. Shinde observed that the since the allegations are general in nature, such dispute and differences could be settled through mediation.
