In the case of _Rupa Singh v. Ministry of Health & Ors. An Assistant Professor of JNU had filed a PIL before the Delhi High Court against the Johnson & Johnson’s ORS product. The opposition to the ORS (Oral Rehydration Salts) product is because the correct composition of ORS is not there and there is apprehension of misleading consumers by simply offering a fruit juice, marketed as an ORS drink.
ORS as a drug under Class 27 of Schedule K of Drugs and Cosmetics Rules 1945 has a very specific composition, and it is used to treat patient suffering from diarrhea, vomiting and dehydration. However, the products by Johnson & Johnson do not have the correct composition as prescribed by WHO, and have high sugar content which might cause harm during diarrhea.
Delhi High Court’s bench of Justices D. N. Patel and Jyoti Singh ordered the Food Safety and Standards Authority of India (FSSAI) to consider the PIL and take action against products which are being sold misleadingly.
