On 18th August Supreme Court held that conviction in rape cases can be done solely on credible evidence of the prosecutrix.
The fact is accused had committed Rape on victim when she was lured by him in his shop.
The Trial court convicted him under Sec 376 (2) (1) Indian Penal Code with rigorous imprisonment for a period of 10 years and fine of ₹ 25000.
The High Court confirmed the conviction.
It was contended by the appellant that as no credible evidence is present, conviction under Sec 376 (2) (1) IPC is justified.
It is argued that oral Evidence of prosecutrix is not supported by medical Evidences.
The State contented that conviction can be based on sole testimony.
The Counsel for the accused relied on the judgment of Santosh Prasad @ Santosh Kumar v. State of Bihar (2020) 3 SCC 443 where it was held contradictions in the evidence of the prosecutrix and the medical evidence has to be looked into by the courts carefully.
Hence the Court held that conviction can be based solely on the evidence of the prosecutrix.
