A 32-year-old woman, who completed 22-week gestation period, had sought permission to undergo medical termination of her pregnancy as her foetus was suffering from various defects and abnormalities.
Advocate Sneha Mukherjee who was representing the woman, stated that the continuation of the pregnancy to its full term not only carried a substantial risk of serious physical handicap to the offspring but also a high chance of morbidity in the foetus.
Earlier, the court had directed to expeditiously constitute a medical board of doctors to examine the petitioner’s issue.
The petitioner had submitted reports by the AIIMS Board of Doctors who confirmed the above claims.
A Bench consisting of Justice Rekha Palli, considered the reports and directed the woman to undergo the process of medical termination of pregnancy.
Considering the circumstances the woman was allowed to terminate her pregnancy, though the Medical Termination of Pregnancy (MTP) Act does not allow termination of pregnancy after a period of 20 weeks.
