The Chairman of the Board of Control for Cricket in India (BCCI) and former Indian cricket team captain, Sourav Ganguly, approached the Bombay High Court for Rs. 36 crores payable as per the 2018-19 arbitral award against Pitect Talent Management and Percept D Mark (India) Ltd. to Rs.36 crores.
Ganguly has alleged that the directors of Percept have systematically “defrauded” other companies in which they are directors from the company to avoid payments to creditors. Therefore, it is necessary and in the interest of justice, the “corporate veil” is removed from the debtors.
The proceedings arose out of an agreement called the “Player Representation Agreement”, which was signed between the two in October 2003 with a term of 5 years.
According to this agreement, Percept Talent Management was to act as Ganguly’s sole and exclusive manager and agent in respect of certain defined and commercial rights.
However, disputes and differences between the parties led to him terminating the agreement by notice to him in November 2007, after which Ganguly invented the arbitration clause.
According to Ganguly, Approx Rs. 36 crores is due to him despite it. 2 crore already paid.
The petition states that the Calcutta High Court on April 7, 2021, dismissed the application of the respondents filed under section 36(2) of the Act for unconditional and conduct of the award.
