On Tuesday, the Supreme Court suspended the hearing in relation to the petitions of aspirants of civil services whose candidature was canceled due to non-submission of proof of educational qualification.
The plea filed through Advocate Tanya Shree, contends that cancellation of candidature is arbitrary, discriminatory and unreasonable among the candidates that are situated similarly and thus violative of Article 14 and 21 of the Constitution.
The bench headed by Justice AM Khanwilkar, held that the parties were yet in the process of reaching an amicable decision and hence the matter has been deferred for a period of 6 weeks.
The petition was filed by a few aspirants of civil services upon cancellation of their candidature due non-compliance with the Rule 7 and Rule 11 of the Civil Services Examination Rules, 2020.
The counsel on behalf of UPSC while opposing the petition filed submitted a Counter affidavit stating that terms of eligibility cannot be relaxed for a few candidates as it would be against the principles of Article 14 and Article 16 of the Indian Constitution.
