Digital Media Content Regulatory Council had its first hearing

Digital Media Content Regulatory Council (DMCRC) is a self-regulatory body which is formed as per the mandate of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

DMCRC is expected to create a credible, robust and practical code for content, with an inclusive and fair governance structure.

Former Supreme Court Judge, Justice Vikramjit Sen is the Chairman of DMCRC. The Council also consists eminent members such as:

  1. Ashok Nambisan, General Counsel of Sony Pictures
  2. Mihir Rale, IndiaChief Regional Counsel of Star and Disney
  3. Nikkhil Advani, film maker
  4. Tigmanshu Dhulia, writer and director
  5. Ashwiny Iyer Tiwari, filmmaker and director
  6. Deepak Dhar, content producer, distributor, founder and CEO of Banijay Group.

In its first hearing, the DMCRC has dismissed an appeal against the trailer of Grahan, a web series released on Disney+ Hotstar.

The complainants had alleged that the show Grahan, was an artwork of “a sinister mindset” and aimed at setting a false narrative about the 1984 anti-Sikh riots.

They had also accused the makers of the show of attempting to show that a turbaned/Sikh man had been involved in looting and arson.

After watching the trailer, the DMCRC in its order unanimously held that it is unreasonable to judge a long series based on a trailer.

The Council unanimously found that no community has been portrayed in a denigrating manner or in a bad light in the trailer.

It was further stated that there is no allusion or assumption of a Sikh person trying to engineer the riots as alleged by the appellants.

The Council was of the opinion that the trailer is within the framework of the law and therefore, the appeal is not maintainable.
