The Allahabad High Court has ordered The Uttar Pradesh government to enforce its policy of paying Rs 25,000 to anyone who has been illegally detained as a compensation, as well as to take disciplinary action against officials who violate the policy.
The court was hearing a petition filed by Shiv Kumar Verma, who claimed that he and another person were wrongfully detained by police on suspicion of breach of public order. The petitioner in question was involved in a legal dispute with some of his relatives over ancestral property.
On October 8, last year, Varanasi police arrested Verma. On October 12, he filed relevant papers seeking his release, but the case was adjourned until October 21 for paper verification. The petitioner claimed that he was illegally detained from October 12 to October 21, despite having submitted personal bond and other required documents. He demanded payment for the time spent.
The state government has also been directed to post the policy in prominent public places, such as all blocks, Tehsil headquarters, police stations, and district collectorate campuses. The court also directed the government to send a copy of its order to all district and tehsil-level bar associations throughout the state.
