Recently, Kerala High Court quashed a FIR registered under Protection of Children from Sexual Offences Act (POCSO Act) in which a settlement was reached stating doing marriage between the complainant and the accused.
The order was passed by Justice Bechu Kurian Thomas in a petition moved by the 27-year old accused.
The accused was charged of Sections 3, 4, 5I and 6 of the POCSO Act (dealing with penetrative sexual assault) and Section 376(2)(n) (offence of committing rape repeatedly on the same woman) of the Indian Penal Code (IPC).
The Court was earlier informed that the matter between them was settled and the complainant didn’t have any grudges against the accused.
Moreover, the complainant and the accused are in Love with each other nd they also married each other. A marriage certificate was also produced to buttress the claim.
