Election Commission can issue guidelines to ensure government funds are not brazenly used for election campaigns: Madras High Court

The Madras High Court recently expressed its inability to entertain a petition to restrain ministers from drawing salaries out of the public funds from campaigning during elections. It also noted that the Election Commission can put guidelines to ensure that government funds are not unabashedly used for campaigning purposes.

A Division Bench of Madras High Court heard the petition filed by the Ahimsa Socialist Party which seeks directions to stop ministers and opposition leaders from using governments funds for campaigning.

The Court made a few observations while hearing the petition. It remarked that the government functionaries should not use the perks and benefits that are available to them during their term in office while campaigning for elections. It went on to observe that there is a deep-rooted malaise where one has to wear allegiance to a political leader.

The Court stated that the Election Commission will deal with the petitioner’s representation, if not for the upcoming elections, for the future elections.

The petition was disposed of on these terms.
