Hearing for bail Application of lawyer sent to prison for sending birthday greetings to Judge

The Madhya Pradesh High Court will hear a bail application after a lawyer was sentenced to prison for sending birthday greetings to the judge.

Advocate Vijaysingh Yadav was arrested by the Ratlam Police after he sent Judicial Magistrate (First Class) Mithali Pathak an email and a birthday card. He was accused of downloading Pathak’s photo from her Facebook account and attaching it to the birthday card or wish. According to the complaint, Yadav downloaded the judge’s photo without her permission and then sent an email to her official account. Furthermore, because he was not added as a friend on the judge’s Facebook account, any ‘unauthorised access’ or use of the photo would be subject to the Information Technology Act’s provisions.

The accused’s family members had applied for bail on his behalf, but it was denied. As a result, Yadav went to the Madhya Pradesh High Court. Before the High Court, he will be represented by advocate KK Gupta. Yadav argues in his bail petition that he has been charged with unjustified and unwelcome charges. He claims there was “no intention” to harm the judge’s reputation. Furthermore, he has stated that he has little knowledge of ‘internet access’ and social media.
