In terms of Bye-Law no. 17 of the Supreme Court Bar Association, a plea has been filed in the Supreme Court seeking directions to conduct upcoming Supreme Court Bar Association elections2020-2021, solely by means of “secret ballot” in physical form.
The petition argues that more than 70% of the total voters and contestants taking part in the upcoming elections are demanding that it be held in physical form, not in any other form. Advocate Pradeep Kumar Yadav, who is also a contesting candidate in the upcoming elections to the SCBA, is filing it. He claims that a large amount of money from SCBA representatives would be misused to employ virtual election agency services.
The mechanism adopted for the elections was also challenged. ‘It is debatable what the mechanism used by the agency to identify the real voter or no proxy vote will be done, how it will be done and how it can ensure that no mismanagement will occur’, he has challenged.
The petition said, “if the statute provides “for a thing to be done in a specific way, then it must be done in that way and in no other way,” if, according to the Supreme Court Bar Association’s Registered Bye Laws, if the elections have to be conducted by a secret ballot, it must only be done in that way.”
