
A division bench of the Gujarat High Court comprising Justices RM Chhaya and Vaibhavi D. Nanavati have registered a suo motu case to monitor expeditious disposal of criminal proceedings pending against sitting/ former MPs and MLAs in the local Courts under its jurisdiction.
The case was registered pursuant to a recent direction issued by the Supreme Court in Ashwini Kumar Upadhyay & Ors. v. Union of India & Ors., and will be placed before a Bench led by Chief Justice Vikram Nath on November 4, 2020.
After the Supreme Court’s direction, The Gujarat High Court requested the Government Advocates to inform the Registrar General about the pending cases in which they were representing MLAs or MPs. The subordinate courts have also been asked to expedite hearings in criminal cases pending against former or sitting legislators.
