Justice Jayant Nath of the Delhi High Court refused to allow a writ petition filed in relation to the recently conducted inter-college Moot Court Competition by NLU Delhi. The petitioners Debashish Patra and others claimed that the organizers had acted in an arbitrary manner.
The petitioners’ grievance is with regards to their qualification for the next rounds and then the change in decision of the same. They seek direction to disclose the marks after each round. The counsel appearing on behalf the university submitted that the competition was already completed and the markind was based on the sole discretion of the external judges. Further, there was no specific allegation put forth.
Referring to the Bar Council of India’s guidelines that make moot courts a compulsory part of the curriculum, the petitioners justified their stand before the court. However, the court dismissed the petition calling it a misuse of writ jurisdiction and also asked the petitioners to file an RTI instead.
