Allahabad High Court stops UP Sunni Central Waqf Board order, relief for Azam Khan

Allahabad high court prohibited the implementation of the March twenty, 2020 order of the state Sunni Central Waqf Board relating to encroachment and management within the Maulana Mohd Ali Jauhar Trust, Rampurthe Court has also ordered the government authorities to file a reply.

This order was given by a division bench on a petition filed by the Trust.

The Petition had sought-after the quashing of the Wakf Board’s order because it is against natural justice. The Petition states that the board can not interfere in the work of the trust unless there’s sturdy proof. it’s a violation of Section sixty-five of the Wakf Act, 1995. The allegation of management on the mutwalli is groundless.

The Petitioner wasn’t given notice before the order was issued. In such cases, the board doesn’t have the right to take action.
