
Supreme Court reiterates that any stay granted by any court including High Court will automatically expires in 6 month except in cases where good reasons are given for the extension. The directions given in “Asian Resurfacing of Road Agency Private Limited v. Central Bureau of Investigation” was reiterated by Rohinton Fali Nariman, Navin Sinha and KM Joseph on 15th October 2020.
In Asian Resurfacing of Road Agency Private Limited Judgment, the court held that:
“Stay against civil or criminal proceedings in any court has to expiry within 6 months. There can be exceptional situation with good reason. The exception given should be more important than having the trial finalized. The trial Curt has to fix a date with the period of 6 months when an order of stay has been imposed.”
Therefore, reiterating from his case, the Supreme Court has given verdict that all pending stay will expire in 6 month except the extension is granted for a good reason.
