
The National Association of the Blind had filed a public interest litigation in the Bombay High Court seeking for directing the BMC to treat the absence of the disabled as leave with pay, especially the blind and low vision employees.
The arguments made by the petitioners and respondents by a bench consisting of Chief Justice Dipankar Dutta and Justice GS Kulkarni. The bench had decided to reserve their judgement.
The implementation of provisions under the Rights of Persons with Disabilites Act, 2016 by the BMC were also questioned. BMC had responded saying that they were given double the allowance and pension as others.
Both the central government and the Mahrashtra government had earlier issues circulars asking employers to consider the current circumstances and exempt disabled persons from during the lockdown period.
