
The Registrar General of HC was directed by the Karnataka HC to file a suo-motu criminal petition under Section 482 of CrPC for quashing a private complaint which is lodged against a Judicial Magistrate of First Class.
The complaint was filed by C. Manjunath on the administrative side of the HC. He made certain grievances against the Judicial Officer and about some alleged statements made by the officer during state proceeding.
The High Court used its inherent jurisdiction to look after this matter.
The division bench consisted of Chief Justice Abhay Oka and Justice M Nagaprasanna. The bench stated that “If the complaint filed by said complainant is allowed to proceed further, it will completely set at nought the protection granted to judicial officers under the Judges (Protection) Act of 1985.”
In his private complaint to the Principal District Judge, he stated that Sections 166, 205, 120(A), 211, 219, 499 and 34 of the IPC can be referred upon to decide that the Judicial Officer state. The petition will be held on July 27th.
