Vishal singh v. priya@ pihu and anr.
MAT. APP. (F.C.) 327/2019 & C.M. No 53990/2019
A new bride’s conduct at home of not doing anything or not taking initiative in household chores or being in her room can’t be described as cruel behaviour in any sense. Division bench of Justices Hima Kohli and Asha Menon passed such order in an appeal against an order previously passed by Family Court .
Court observed that, “a new bride would be hesitant in her surrounding in their matrimonial home . It is always for the husband’s family to make the new bride feel at home and accepted as a family member. Therefore, such conduct of the wife of being interested in remaining in her room is not showing initiative in doing household work can by no stretch of imagination be described as cruel behaviour of wife towards the husband”.
The Court also appreciated that in affidavit, without of course, giving any specific dates, the husband had claimed that he had “reconciled” with the respondent wife and had hoped for a “bright future” and “had saved his matrimonial life”.
