A bench comprising of Justice Indira Banerjee and Justice BR Gavai on Wednesday rejected Mahender Singh Yadav’s interim bail. Yadav is a co-accused in the 1984 Sikh Riots.
It was stated that every possible treatment was being meted out to Yadav after he was found COVID19 positive. Further, no specific suggestions were put forth by the family in the plea.
Senior Advocate R Basant on behalf of the petitioner contended that Yadav tested positive of COVID19 on June 26 after an inmate died of the same on June 15. Further, 17 other inmates have also tested COVID19 positive. The plea for interim bail stated that Yadav’s health is continuously deteriorating.
Yadav, who is above 70 years of age is accused under Sections 120B read with 436, 153A (1)(a) & (b), 295 IPC for his involvement in the 1984 Anti-Sikh Riots. He has served more than one year and 5 months in prison and has not been granted parole for a single day as of yet.
