Delhi High Court passes an injunction order restraining the defendant from publishing advertisements linking COVID ’19 and Corona beer

In the present case the Respondent has linked the Corona Virus with the Corona beer manufactured by the defendant and posted it on Facebook. The court noted that the Plaintiff made out a prima facie case against the defendant for disparagement. Moreover, it also observed that in the instant case balance of convinence appears to be in the plaintiff’s favour.
The court observed,
” It appears that the plaintiff’s statutory and commercial interests will
get jeopardised if an ad interim injunction is not granted in its favour. “
Thus the court ordered the defendant or any their subordinates to refrain from publishing, reproducing, broadcasting , communicating to the public, screening, publishing, and distributing the material in issue on any media platform, including social media.
