
Election of Gujarat’s Law Minister Manubha Chudasama declared void.
The election of Bhupendrasinh Manubha Chudasama of BJP to the Legislative Assembly of the State, was declared void, stating that it was a violation of Representation of the People’s Act , 1951.
In 2017, Gujarat Elections, BJP party contender Chudasama won over Congress Candidate Khamsubhai Rathod. the validity of this election was contended by Rathod in the High Court of Gujarat stating that 429 postal ballot was excluded by the Returning Officer, Dhaval Jani, from the vote count.
The Gujarat High Court declared that it was well proved that 429 ballots were not counted. Under Section 100(1)(d)(iii) and Section 100(1)(d)(iv) of the Representation of the People’s Act, 1951, rendered this election void. Under Section 123(7) of the Same Act , “corrupt practices” were conducted in the election.
The election was declared void but the prayer made by Rathod to declare him as the winner of the elections was refused.
