
Queen’s Counsel Harish Salve stated that Maybe it’s time to revisit The ICJ regarding Kulbhushan Jadhav Case.
The ICJ had ruled in favour of India and prevented Kulbhushan Jadhav to be executed. He remarked that Kulbhushan Jadhav had consular access according to the Vienna Convention, which has still not been given by the Pakistan Government inspite of repeated attempts by India to grant such.
The Senior Advocate went on to remark that the confession of Kulbhushan Jadhav , which was the only piece of evidence in the hands of the Pakistan Government, should be disregarded as the consular access should have been granted to him before recording such confession.
Mister Salve also remarked that invoking “treaty jurisdiction” of the ICJ , The Vienna Convention came into play but this excluded the human rights under ICCPR from being spoken about.
Finally, The Senior Advocate , Harish Salve remarked “…Someday, we shall have him back.”
